Derek Chauvin’s Legal Team Formally Requests A New Trial Weeks After He Was Convicted In The Murder Of George Floyd

Roommates, Derek Chauvin’s attorney has just filed a request for a new trial, citing a number of reasons Chauvin didn’t receive proper justice during his recent trial for the murder of George Floyd, for which he was convicted on all counts. Just weeks after he was found guilty of murdering George Floyd last May, Derek Chauvin’s legal team has officially moved forward with their efforts to secure him a new trial—despite the swift deliberation weighing his guilt during his recent trial.

Derek Chauvin’s lead attorney, Eric Nelson, has officially filed the request for a new trial for a number of reasons, with the main reason being he believes that Chauvin’s ability to have a fair trial was affected by a large amount of pretrial publicity. The formal court motion further alleges that the court abused its discretion by denying the requests of Chauvin’s legal team for a change in venue and a new trial.

In Nelson’s filing he wrote that since the court failed to sequester the jury or “admonish them to avoid all media,” they were not only subjected to prejudicial publicity but also “jury intimidation or potential fear of retribution.” Nelson’s motion for a new trial includes a total of eight allegations of abuses of discretion by the court.

Within his court filing, Eric Nelson also accuses Minnesota prosecutors of committing “pervasive, prejudicial prosecutorial misconduct”—which allegedly further impacted Chauvin’s ability to receive a fair trial.

The request for a new trial for Derek Chauvin additionally requested an order “to impeach the verdict” on “the grounds that the jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and/or failed to adhere to instructions during deliberations.”

As of now, prosecutors in the trial have yet to publicly respond to the request for a new trial.
